This is a Place to consider changes needed to Protect our Democracy
We have often heard that our government has a balance of power between the branches but in reality it is clear that the Judicial Branch and ultimately the Supreme Court has veto power over the other two branches and the power to control the laws of this nation. The Judicial Branch is only constrained by the Constitution but has the sole power to interpret the constitution and thus can create or destroy legal precedents. Since the constitution was written over 200 years ago much has changed in the world and in our government and the politics of our country. When the constitution as originally written is not clear enough or doesn’t cover modern technology the court can interpret it as it wants. Therefore we need to make the constitution clear so it protects the broad spectrum of our society not just the rich and large corporations. The following are some changes to insure that the court system will be required to protect the people of our society.

In order to get a reasonable and fair vote count each individual must Sign Up if a first time visitor or Login if a return visitor in order to vote. Budget
If a budget is not passed by the Congress and the President when required then the government must continue operating under the previously passed budget until a new budget is passed.

Elections I
The election of the President shall be determined by popular vote and Legislatures can not override the popular vote. The states shall be responsible for running the elections and counting the votes and shall follow regulations passed by Congress for Federal elections to ensure fairness and equal access to all citizens.

Elections II
All elections for Federal office must be made by Rank Choice Voting. All qualified candidates shall run in the same open primary and the four candidates with the highest number of votes shall run in the final election for that office using the following Instant Runoff Method. If in the initial vote there is a candidate with a majority of the votes that candidate will be declared the winner. If initially there is no candidate with a majority the candidate with the lowest number of votes is eliminated and those votes will be allocated to the second choice of the voter. If then one candidate has a majority of the votes that candidate will be declared the winner. If at this point there is no candidate with a majority of the votes then the candidate with the next least number of votes is eliminated and those votes will be allocated to their next choice. The candidate with the most votes at this point will be declared the winner.

Term Limits
Members of both Houses of Congress and the Supreme Court shall be subject to term limits like the President of the United States. The members of Congress shall retire at the end of the elected term in which they have served for 18 years. The members of the Supreme Court shall retire at the end of the Court session in which they have reached 18 years of service.
Those members of the Supreme Court originally appointed for lifetime service are now required to retire in the following order. The member with the longest time of service over 18 years shall retire at the end of the session in which this amendment is adopted. The member with the next longest time of service over 18 years shall retire at the end of the next session following the previous retirement enforced by this rule and this procedure shall continue until all members have served less that 18 years.

Gun Legislation I
The States and local governments may enact laws regulating how and if private citizens may carry guns in public places and at public events.

Gun Legislation II
Private citizens may not own or possess fully automatic weapons unless licensed to do so. Full automatic weapons may only be transported in secure locked containers.

Personal Rights
All persons must have the ultimate and final right to request and control any and all medical procedures on their own bodies which are considered as valid and reasonable procedures by the majority of the medical profession.
Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex

Money
Money shall not be considered the same as speech. It’s use in political matters shall be controlled by law passed by Congress. All financial political contributions must be made known to the public.

Legislative Holds
No single Congress person may place a hold on any legislative or administration action. If any group of congress persons place a hold on any legislative or administration action a larger group may vote and have that hold removed.

Presidential Powers
The President is not above the law. While the President must be free from prosecution while President for any action related to the proper function of government and other actions unless impeached by Congress after the term of office is over and he is no longer in office he is subject to all laws exactly like any other citizen including illegal personal actions while President which are not part of the explicit responsibility of the office.
The President is not permitted to give pardons during the time from 1 week before election day for the next presidential term begins until the end of the current term.

Corporations
Corporations and businesses shall not have the rights of individuals except as provided for by law enacted by Congress along with laws to enforce fair and honest behavior.
